NOTICE OF HEALTH INFORMATION PRIVACY PRACTICES (HIPAA)

THIS NOTICE APPLIES ONLY TO CLIENTS RECEIVING CLINICAL SERVICES

This Notice explains how your protected health information (PHI) is used and disclosed when you are receiving clinical services (such as counseling or therapy) at The Living Well Collective Co. (TLWCC).

It also explains how this differs from using our website, app, programs, and general offerings.

IMPORTANT: USER VS. CLIENT

To provide clarity, TLWCC distinguishes between Users and Clients.

Users (Website, App, Courses, and Community)

You are considered a User if you:

  • join our website or app

  • subscribe to emails or newsletters

  • register for events, workshops, or groups

  • participate in courses or programs

  • access resources or content

As a User:

  • you may provide basic information such as your name, email, or phone number

  • you are engaging in non-clinical services

  • you are not entering into a therapeutic relationship

Information submitted in these contexts is not considered protected health information (PHI) under HIPAA.

 

Clients (Clinical Services)

You are considered a Client if you:

  • complete intake for counseling or therapy

  • engage in clinical services with a licensed provider

As a Client:

  • your information becomes protected health information (PHI)

  • your information is stored in our secure electronic health record system, Practice Better

  • your information is protected under HIPAA

 

IMPORTANT GUIDELINE FOR USERS

Information submitted through the website, app, courses, or programs should not include sensitive or confidential health information.

Examples of information you should not submit outside of clinical services include:

  • diagnoses or symptoms

  • therapy-related concerns

  • personal mental health history

  • detailed personal disclosures

 

COMMUNITY AND GROUP SETTINGS

Some Users may participate in:

  • group experiences

  • workshops

  • online or app-based community spaces

Please note:

  • these environments may involve interaction with other participants

  • participants may choose to share personal information

Because of this:

  • we cannot guarantee the confidentiality of information shared in group or community settings

  • you are responsible for what you choose to share

 

WHAT IS PROTECTED HEALTH INFORMATION (PHI)?

Protected Health Information (PHI) is:

Information that identifies you and relates to your physical or mental health, treatment, or payment for healthcare services.

Examples include:

  • therapy session content

  • diagnoses or symptoms

  • treatment plans

  • billing or insurance information

Basic contact information (name, email, phone number) only becomes PHI when it is connected to clinical care.

 

HOW WE USE AND DISCLOSE PHI (CLIENTS ONLY)

For Clients receiving clinical services, we may use or disclose PHI for:

 

Treatment

To provide and coordinate care

 

Payment

To bill and receive payment

 

Healthcare Operations

To manage and improve services

 

Required by Law

Including abuse reporting, court orders, and public health requirements

 

Serious Threat to Health or Safety

To prevent harm when necessary

 

Communication

For appointment reminders and service-related communication

SPECIAL PROTECTIONS

 

Psychotherapy Notes

Psychotherapy notes are maintained separately in our electronic health record and receive additional protection.

They are not stored on this website and are not disclosed without written authorization except as permitted by law.

 

YOUR RIGHTS (CLIENTS ONLY)

Clients have the right to:

  • access their records

  • request amendments

  • request restrictions

  • request confidential communication

  • receive an accounting of disclosures

  • obtain a copy of this Notice

 

ELECTRONIC COMMUNICATION

Electronic communication (email, text, or app-based messaging) carries some level of risk.

For clinical communication, Clients may be directed to use our secure client portal.

 

OUR RESPONSIBILITIES

We are required to:

  • protect the privacy and security of PHI

  • follow the terms of this Notice

  • notify Clients in the event of a breach

 

CHANGES TO THIS NOTICE

We may update this Notice at any time. Updates will be posted on our website.
